legislative branch at work # 3

source: " Kagen to join Supreme Court Saturday" September 19,2010

Constitutional Connection: Article I, section 3, clause 5
"The Senate shall chuse their other Officers, and also a President pro tempore, in the absence of the Vice President, or when he shall exercise the Office of President of the United States."

Explanation of Connection: the Constitution gives the president the right to appoint Office members. but it is the power of the Senate to decide whether that appionted person can go on to actually hold the government office title he or she was appointed to hold. Preseident Barack Obama recently appointed Elana Kagen as a supreme court justice.
The article represents  Article I, section 3, clause 5 of the United States Constitution. senate has the power to choose the people they want to hold an office position appointed to them by the president. this article shows that it is the sole responcibility of the Senate to choose important government Officers. the ability to choose Officers is a special power only given to the Senate who is of much older age than the House of Representatives.
i think it was a good choice for the founding fathers to give important powers of choice to the Legislature. i think it was an even greater idea to give that power and responcibilty to the older of the two groups. I dont think that government would be the same if the president got to make the final appointments: politics would be thrown off and everything would be corrupt. I dont  dissagre with any parrt of the above cause.

Constitutional Connection: Article 1, section 8, Clause 1
"The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States"

Explanation of Connection: It is the job of the legislation to "provide for the common Defense and General Welfare of the United States". Congress are bickering over whether free healthcare should be given to U.S citizens.it is a trending topic and a issue seen all over politics. In providing for the welfare of the United States the health of the popel that inhabit it should be greatly considered.
This video demonstrates Article 1, section 8, Clause 1 of the united states constitution. Along with laying an collecting taxes congress must prvide for the general welfare and defense of the people. in doing that they can provide healthcare and security .This video demonstrates the power the votes of both sides of Congress and how there votes can potentialy change the lives of millions of Americans.
I agree with the vote of congress to give free health care to all Americans. i found the video to be interesting because it gave numbers and info about the bill and how many members of congress participated in passing the Healthcare Bill. I also like how passing this Bill made such a historic impact on America. But I dont see what the big problem was in why people did not want the Bill to be passed.

Lesgislative branch in action #1

Source: "The Hopper: Puppy Love"
http://www.congress.org/news/2010/07/19/the_hopper_puppy_love

Constitutional Connection: Article 1, The legislative Branch, section 7, Clause 1
"All bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills"

Explanation oc Connection:Animal welfare is not a big issue  but it is one that does recieve alot of attention from time to time. there are many activist fighting for better protection of animals under the law and some of those activist can be found in congress. but in order for certain rights of the animal to become law it must "originate" in the House of Representatives.
This article demonstrates Article 1,  Section 7, clause I of the United States Constitution. The Puppy Uniform and Safety act (PUPS)  is one such bill that must start in the House of Representatives. the bill is focused on protecting the rights of puppies being sold. This article shows how a Representative member can propose a bill that would be considered into voting and then passed as a law if succesful.
If Bills didnt have to originate in the House of Reps then the way laws would be passed would be so out of control and in a sense the system of checks and balances would be eliminated or dramaticaly altered. There could be a possibillity that the bills couls start in the executive branch and that could lead to a dictatorship with the president being given the power to propose laws. However, i do think that some of the power to propose bill should be given to the poepl who would later on hae to follow them and the vote and the voice of the people along with the Senate and House should be ocnsidered when choosing if a bill should be made a law.

tenth amendment

Constitutional Connection:

Article X, The BIll of Rights: " The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectivly, or to the poeple."

fifth amendment

Constitutional Connection:

Amendment V, Bill of Rights;" No person shall be held to answer for capital, or otherwise infamous crime, unless, on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger;nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any Criminal Case to be a witnes against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Analysis:

when making the fifth amendment the founding fathers gave a person on trial the right to decide if they wanted to be a witnes against themself or not. that right is clearly demonstarted when a person is arrested and police state that they have the rigth to " remain silent" and have a "fair trial"

the above carton shows a man who is on trial and how he has chosen to stay silent. The attorny cross examining him is dissapointed in the man excersising that right because now he doesnt get to "show off"

I agree with this bill in some areas. Mainly about where a person has the right to remain silent because no person should be forced to testify against his or herself in a court of law if they dont want to.

fourth amendment

Constitutional Connection:

Amendment Iv, Bill of Rights:" The right of the poeple to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to beb searched, and the persons or things be siezed.

Analysis:

The founding fathers wanted to prevent search and siezure problems they encountered in England. they took into consideration a mans right to property and how a person should be able to take a mans property or search it with out proper documentation stating that they could.

When making the fourth amendment th founding fathers made it so that government agents must have a llegal warrant in order to search and sieze a persons property of self and physical property.

The above cartoon illustrates government agents doing an unwarranted wiretap on a baby ( but they dont know that) because it is unwarranted they dont have any idea who they are listening to, and the cartoon shows that. The situation could have been avoided had they have gotten a warant then they would know who they are listening to.

I  dont know what the world would be like if it wasnt for the fourth amendment. i think that eveyone would be wire tapped and spied on by the government and no one would have any type of privacy within their own homes and institutions. And i think the founding fathers made a good choice in protecting that right of the poeple.

2nd Amendment: the right to bare arms

Constitutional connection: The Bill of Rights, 2nd Amendment, "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

explanation of connection:
