Constitutional Connection:
Amendment V, Bill of Rights;" No person shall be held to answer for capital, or otherwise infamous crime, unless, on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger;nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any Criminal Case to be a witnes against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use,without just compensation.
Analysis:
when making the fifth amendment the founding fathers gave a person on trial the right to decide if they wanted to be a witnes against themself or not. that right is clearly demonstarted when a person is arrested and police state that they have the rigth to " remain silent" and have a "fair trial"
the above carton shows a man who is on trial and how he has chosen to stay silent. The attorny cross examining him is dissapointed in the man excersising that right because now he doesnt get to "show off"
I agree with this bill in some areas. Mainly about where a person has the right to remain silent because no person should be forced to testify against his or herself in a court of law if they dont want to.
